<p>TOPEKA — Kansas Department on Aging  Secretary Martin Kennedy said Wednesday that it is “fairly likely” he  will have to start a waiting list for Medicaid-funded in-home services  for the frail elderly, something that hasn&#8217;t happened since 2002.</p>
<p>“We’re looking at our options,” he said at meeting with advocates and  program directors.</p>
<p>Kennedy explained that earlier cuts in spending had fallen short –  “by about $2 million” &#8211; of the amount needed to balance the department’s  budget for the 2010 fiscal year, which ended June 30.</p>
<p>The deficit, he said, was offset with some last-minute “cuts and some  shifts in funding.”</p>
<p>But in the current fiscal year, the shortfall is expected to be  between $5 million and $6 million.</p>
<p>He said the department’s budget wasn&#8217;t keeping pace with the demand  for home and community based services.</p>
<p>Without these services, he said, many frail seniors are likely to end  up in nursing homes, significantly increasing the department’s costs.</p>
<p>“That’s really a terrible option,” Kennedy said of the possible  waiting list. “It forces us to cut expenditures in a program that saves  us money.”</p>
<p>Kennedy said he will ask for a midyear increase in spending authority  but had no way to know if it would be approved by Gov. Mark Parkinson,  his successor, or the 2011 Legislature.</p>
<p>Parkinson is not seeking re-election. His replacement will take  office in January.</p>
<p>Though the Parkinson administration is assembling a proposed budget  for fiscal 2012, the next governor will be free to accept or reject any  or all of it.</p>
<p>“Some tough decisions are going to be made,” Kennedy said, noting  he’s already shelved plans for a $1.1 million expansion of telehealth  services for frail seniors. Instead, that money will be used to help  offset the agency&#8217;s budget gap.</p>
<p>Faced with a similar deficit in 2002, KDoA enacted its first and,  thus far, only waiting list for in-home services for the frail elderly.  That waiting list remained in place for about two years.</p>
<p>According to KDoA data, the waiting list coincided with a 337-person  increase in the numbers of frail seniors moving to nursing homes.</p>
<p>Currently, about 5,700 seniors receive Medicaid-funded, in-home  services. Each month, about 146 begin receiving services and 105 leave  the program.</p>
<p>Dan Goodman, executive director at the Johnson County Area Agency on  Aging, warned that a waiting list is sure to hurt vulnerable seniors.</p>
<p>“Studies have shown that when both of us – HCBS and nursing  facilities – care for someone who’s considered frail elderly, it’s  usually for about three years,” Goodman said. “So for me the question  comes down to two things: Quality of life and cost to the state. Now, we  ought to be looking for win-win solutions. Going to a waiting list is  lose-lose. It’s going to cost more and it’s not what people want.”</p>
<p>Shannon Jones, executive director for the Statewide Independent  Living Council of Kansas, urged Kennedy to propose taking advantage of  federal health reform provisions meant to expand access to home and  community based services.</p>
<p>“Medicaid was passed 45 years ago,” Jones said, “and we all know that  a lot of the rules and regulations that came with it are, in the world  we live in today, antiquated. I mean, the fact that nursing services are  an entitlement and home and community based services are optional is  totally upside down.”</p>
<p>Kennedy said he was all for expanding access to in-home services.</p>

			<content:encoded><![CDATA[<p>To protect the consumer, new legislation went into effect January 1, 2010, requires all Kansas home inspectors be registered with the Kansas Home Inspectors Registration Board (KHIRB) in order to provide home inspection services. If a home inspector does not register with KHIRB by this date, they are prohibited from performing home inspections.  KS Home inspectors also are required to carry a minimum amount of liability insurance. <span id="more-2616"></span></p>
<p>As of December 29, 2009, over 80 home inspectors across the state had already registered with KHIRB.</p>

<p>In Missouri there is no such requirement at this time. However, many of the home inspectors registered to do business in KS also do home inspections in MO.</p>

			<content:encoded><![CDATA[<p>Consumer protection regulations have been put in place to ensure that homebuyers receive better information, especially regarding cost disclosures, earlier in the mortgage process.</p>
<p>New Truth in Lending disclosure requirements take effect July 30, 2009 and the timing of your closings may be impacted.  With the new regulations you may need to plan for at least a 30-day close if the homebuyer is financing the property.  <span id="more-1511"></span></p>
<p>As of July 30, lenders will be required to comply with revised Truth in Lending Act good faith estimate (“early disclosure”) requirements which will:</p>
<p>•require delivery or mailing of the early disclosures within three business days of receiving a consumer’s mortgage loan application.  A lender also must wait until at least seven business days after delivery of the disclosures before consummating the mortgage loan.</p>
<p>•require corrected disclosures to be delivered at least three business days before consummation if the annual percentage rate (APR) provided in the early disclosures changes more than .125% from the initial Truth in Lending Disclosure.</p>
<p>•expand the requirements to mortgage loans secured by any dwelling of a consumer.  The requirements no longer are limited to a consumer’s “principal dwelling.”  The early disclosure requirements also now cover refinancings and home equity loans.</p>
<p>•prohibit a lender from charging a consumer any fee, except to obtain a credit report, until after the early disclosures have been provided.</p>
<p>•permit a consumer to expedite the closing of a mortgage loan subject to the early disclosure provisions to address a personal financial emergency, such as foreclosure.</p>
<p>•inform a consumer that he or she is not required to complete the transaction because the consumer has received the early disclosures or applied for a loan.</p>
<p>Discuss these new provisions with your lender or mortgage broker as well as your settlement agents to avoid unnecessary delays during the transaction.  Provide the settlement agent information to the lender as early in the process as possible.  It’s critical that any third party fees that impact the APR are accurate.</p>
<p>Buyers need to understand that their interest rate impacts their APR.  Until that rate is locked with their lender, which is at the buyer’s discretion, the initial Truth in Lending Disclosure (TIL) will not be accurate, so a PreClosing TIL will likely be needed.  It’s recommended that buyers should minimally plan on locking at least 10 business days prior to the date they wish to close.</p>

			<content:encoded><![CDATA[<p>Last week, the Kansas Senate approved legislation (HB 2092) on a unanimous vote of 40 to 0 that protects homebuyers from hidden fees buried in the deed covenants that require them to pay a private transfer fee (typically 1% of the sales price) to a designated third party.. HB 2092 passed the Kansas House of Representatives last month on an overwhelming vote of 123 to 2. This legislation has now advanced to the Governor’s desk for her signature. <span id="more-1097"></span></p>
<p>This practice, which is widespread in other areas of the country, has led to many failed real estate transactions due to disputes over the fees and can cause numerous title defects in the property that can prevent the buyer from obtaining title insurance or mortgage financing. If approved by the Governor, this legislation would make all private transfer fee provisions unenforceable against future owners of the property.</p>

<p><strong>Homeowner Affordability and Stability Plan<br />
</strong>On February 18, 2009, President Obama announced his Homeowner Affordability and Stability Plan, designed to help up to 7-9 million families avoid foreclosure by restructuring or refinancing their mortgages. In doing so, the plan not only helps responsible homeowners behind on their payments or at risk of defaulting, but prevents neighborhoods and communities from being pulled over the edge too, as defaults and foreclosures contribute to falling home values, failing local businesses, and lost jobs. <p><strong>NAR Opposes Mortgage Interest Deduction Provision</strong> in Obama&#8217;s Budget Proposal<br />
As currently drafted, President Obama&#8217;s proposed budget changes the Mortgage Interest <strong>Deduction by reducing the amount of mortgage deductibility for individuals earning over $200,000 and $250,000 for married couples. </strong>This proposed change in the Mortgage Interest Deduction will result in further erosion of home prices and home values. If this proposal is enacted it will set off a new round of price depreciation, and will cause greater distress on the balance sheets of banks as the collateral value of mortgage backed securities declines. A second credit crisis could emerge before the first one is resolved.  Budget</p>
